So the name, the moves, the gimmick are all irrelevant, CM Punk owns his own face and has to give permission for it to be used. As a WWE worker, consent is given. Currently he's not under WWE contract so he has to give consent (just like all the WWE Legends that either personally give permission, or the estate does). So no he's not having a bitch or a whinge, if a videogame used my face and I wasn't getting paid for it, I would sue as well. 1 Quote

Contract for a game =/= Contract as a Wrestler. Goldberg was in last years game, I assume everybody thinks he had a WWE contract aswell? As for people who are dead, the WWE owns their name, their likeness etc., so someone within the company can sign the contract OR, if the WWE for whatever reason does not own the rights to a specific wrestler, a family member of a said wrestler has to sign a contract, as simple as that. Video games usually sign the contracts to their games about half a year before they even start developing the actual game, and since Punk probably had a multi-year contract, it's very likely that 2k still has the right to use him in the game. Now, that's all just speculations. Nobody can really know wether CM Punk still has/had some sort of a contract going with 2k, so there is no point in guessing and fighting over it. Quote

Titavius Posted September 4, 2014 Posted September 4, 2014 First of all, 2K ARE responsible, NOT WWE. The only reason we had RVD in 2011, and Hogan in 2k14 was 2K/THQ had their own permissions. WWE can still supply things like music and video footage for those performers, but the characters themselves had contracts with the publishers. Punk can claim a share of the royalties that WWE receive, but as he breached his contract, I really don't know why he'd bother. Punk will probably be on the disk. It's too late to physically extract his likeness from the disk. However, they can completely lock him down, kind of like an NPC, so he'll be completely hidden and inaccessible. They've done this in the past tons of times. Quote
