Daulten780 Posted September 3, 2014 Posted September 3, 2014 Source: Wrestling Observer Newsletter CM Punk's lawyers recently sent a 22-page letter to WWE over royalties and their use of his likeness, mainly him being featured in the WWE 2K15 video game. This isn't confirmed but WWE may have stopped sending Punk royalty checks over their claim that he breached his contract. Regarding the video game, the roster was put together before Punk quit the company. Could he be removed in the next month because of this? A bit worried. Does WWE have a case with him breaching the contract do you think? Quote
xWreckIntent Posted September 3, 2014 Posted September 3, 2014 Ouch. This is gonna be a clusterfuck. If they actually do take him out, 2K would be CHEWED and it wouldn't even be their fault. Quote
DrJoeyMagnum Posted September 3, 2014 Posted September 3, 2014 He won't be removed he's part of the rivalry mode with Cena Quote
BrokenDreams23 Posted September 3, 2014 Posted September 3, 2014 Phil Brooks is a massive toolbag bitch, no matter what people say & how much they try to defend him............it only makes you look ignorant. The game was developed before he left, without a heads up mind you, and features him as more than just a simple "lock & block" character & either he doesn't understand that or he's just looking for easy money. Basically, I don't see him winning, but good luck trying. Quote

Don't spout bullshit without doing any studying please. He owns the name. His merchandise was getting sold and he wasn't getting any royalties. Same with this game, his name and character that he owns is getting milked for money and he isn't getting any in return. He has every right to sue. Quote

Your character and name that you created is getting sold and you are not getting any money for it, your merchandise that you helped create is getting sold and you are not getting any money for it. Your character and likeness are getting milked inside a video game and you are not getting any money for it. Don't bullshit, you would sue. 1 Quote

I like how you assume/presume to know me & my stances on things. Maybe not everyone cares about money. Plus like I said, it's not like WWE are actually milking the name & likeness, last I checked we're talking about a video game by a developer that isn't WWE & isn't something that you can just simply write off or remove & it's not like people will be buying WWE 2K15 just for one guy, that's pretty arrogant to think if that's what he thinks, not to mention that only a portion of the game's sales would go to WWE & for everything in it, not just one guy who, again, just up & left & didn't give a notice so that all parties involved could remove all traces of him. Again, understanding of how coding of video games works is a key factor here, it's not like 2K can just simply remove the coding & especially with how close it is to release time. So yeah his chances of actually being able to sue WWE are very slim, especially if they counter with breach of contract. Quote
Twistedmisery666™ Posted September 3, 2014 Posted September 3, 2014 Damn now there gonna hold the game back now to take him out damn. Quote
Sunny Posted September 3, 2014 Posted September 3, 2014 Stupid move trying to sue a billion dollar corporation. Daddy Mac beat sex allegations and steroid distribution. This silly little copyright mismanagement claim ain't shit. Quote

Did you read it on the internet somewhere and ASSUME it was correct? They are taking his name and putting it in a game, not asking him, not giving him money for using his own name and likeness. This can be sued for. He will win the case if he decided to press charges. Quote

fufu ÷ Posted September 3, 2014 Posted September 3, 2014 Pretty sure he woulda signed his likeness over before he was even scanned or whatever. You have to get wavers before anything like that can even take place. It's the same with film and TV and what have you. It'll either get settled pretty quick or thrown out entirely. Depends whether the working contract he had with WWE was directly linked with the contract for the game. Quote
MykeMadness Posted September 4, 2014 Posted September 4, 2014 I would guess when he signed with WWE they had a "likeness" Claus in it that says they can use it any way they see fit (don't hold me to that) From what I have read online, Mr Brooks left the company before scans were taking place. These articles may be totally wrong but I do not know for sure. All I know is that, due to his popularity, CM Punk is one of the top draws for the game and would definitely influence game sales. IF Mr Brooks has breached the terms of his Contract they would be welcome to use this as a counter argument in this court case. Disclaimer I am not directly involved with these things so do not take these words for fact. Thank you! Quote
