If they had kept the model file with his appearance on the disc they would be breaking laws, they would have been sued. They need his permission to use his appearance in a commercial product, they didn't get it, instead he signed with Acclaim to appear in LOW Showdown. Same goes for Jeff Hardy, and Hulk Hogan. They're not in there, people shouldn't have wasted their time in the first place looking if they just stopped and thought for a second.
